Terms of Service
These Terms of Service ("Terms") are an agreement between you and Braden Ross, doing business as Feedia ("Feedia," "we," "us," or "our"). They govern your use of the Feedia iOS application and any related services we provide (collectively, the "Services").
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use Feedia. By using the Services, you represent that:
- You are at least 13 years of age.
- You have the legal capacity to enter into these Terms.
- You are not barred from using the Services under the laws of the United States, your country of residence, or any other applicable jurisdiction.
- You will comply with these Terms and all applicable laws.
If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration and Security
To use most features of the Services, you must create an account. When you register, you agree to:
- Provide accurate, current, and complete information, including a valid email address and your real first and last name.
- Maintain the security of your password and not share your credentials with anyone.
- Notify us promptly at support@feediaapp.com of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
You may have only one account at a time. We may suspend or terminate accounts that we determine, in our reasonable judgment, violate these Terms or are duplicates of previously suspended accounts.
3. Your Content and License Grant
3.1 You own your content
Anything you create or upload through the Services — recipes, cookbooks, bites, comments, reviews, photos, profile information, direct messages, and similar content (collectively, "Your Content") — remains your property. We do not claim ownership of Your Content.
3.2 License to Feedia
To operate the Services, you grant Feedia a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, perform, modify (for example, to resize images for different screens), distribute, and otherwise use Your Content in connection with operating and providing the Services. This license exists for the sole purpose of running Feedia and lasts only as long as Your Content remains on the Services, except as noted in Section 3.5 below.
3.3 License to other users
When you make content public (such as a public recipe, comment, or review), you also grant other Feedia users a license to view, save, repost, and engage with that content within the Services, in accordance with the features Feedia provides.
3.4 Your representations
By posting content to the Services, you represent and warrant that:
- You own or have all necessary rights to post the content and grant the licenses described above.
- The content does not infringe any third party's intellectual property, privacy, or other rights.
- The content does not violate any law or these Terms.
3.5 Content after account deletion
When you delete your account, most of Your Content is removed in accordance with our Privacy Policy. However, certain content that other users have already engaged with — specifically comments, reviews, and direct messages — may be retained in anonymized form (attributed to "Deleted User") to preserve the integrity of conversations. This anonymized retention cannot be linked back to you and continues under the license described in Section 3.2.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation, or encourage others to do so.
- Post or transmit content that is illegal, harassing, threatening, defamatory, hateful, sexually explicit, violent, deceptive, or otherwise objectionable.
- Post content that infringes a third party's intellectual property rights, trademarks, privacy, or publicity rights.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Send spam, chain letters, unsolicited advertising, or unauthorized commercial communications.
- Collect or harvest information about other users without their consent.
- Use bots, scripts, scrapers, or other automated means to access or use the Services, except as expressly permitted.
- Probe, scan, or test the vulnerability of the Services, or breach or circumvent any security or authentication measures.
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except where expressly permitted by law.
- Interfere with or disrupt the Services, the servers or networks that host the Services, or any other user's enjoyment of the Services.
- Use the Services to develop a competing product or service.
- Encourage or enable any of the above by another person.
We may remove content or take action against accounts that we determine, in our reasonable judgment, violate this section.
5. AI-Assisted Features
Feedia includes optional AI-assisted features such as importing a recipe from a URL or scanning a photo of a recipe. These features use third-party AI services, including OpenAI.
- You choose when to use them. AI features are opt-in. You can always create recipes manually instead.
- Output may be inaccurate. AI services may produce incorrect, incomplete, or misleading results. You are responsible for reviewing, editing, and verifying any AI-generated content before saving or relying on it.
- You own the result. Once you save AI-generated content to your account, it becomes Your Content under Section 3.
- Don't use AI features to import content you do not have rights to. Importing copyrighted recipes or content you don't own can violate third-party rights and these Terms.
6. Nutrition and Health Information
Feedia may display nutrition information (calories, macronutrients, etc.) supplied by third-party services such as Spoonacular, or generated based on recipe ingredients. This information is provided for general informational purposes only.
Feedia is not a medical, dietary, or nutrition service. Nutrition information shown in the Services is an estimate that may be inaccurate or incomplete. It is not a substitute for advice from a qualified health professional. Do not rely on Feedia for medical, dietary, allergy, or health-related decisions.
You are responsible for evaluating any recipe or nutrition information before preparing or consuming food, including assessing ingredients for allergies, dietary restrictions, food safety, and personal suitability.
7. Feedia+ Subscriptions
Some features of the Services require a paid subscription to "Feedia+." Subscriptions are sold and processed by Apple through the App Store.
- Billing. Apple is the merchant of record for all Feedia+ subscriptions. Feedia does not collect, receive, or store your payment information. All charges, refunds, and billing inquiries are handled by Apple in accordance with the Apple Media Services Terms and Conditions.
- Auto-renewal. Feedia+ subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your iOS device's Apple ID account is charged for renewal at the price disclosed at the time of purchase.
- Managing your subscription. You can view, change, or cancel your subscription at any time by going to iOS Settings → Apple ID → Subscriptions.
- Refunds. Refund requests are governed by Apple's refund policy. To request a refund, follow Apple's process at reportaproblem.apple.com. Feedia cannot process refunds directly.
- Free trials and promotional offers. If you accept a free trial or promotional offer, Apple's standard auto-renewal terms apply at the end of the trial unless you cancel beforehand.
- Price changes. We may change subscription prices from time to time. We will provide notice of any price change before it takes effect, and you may cancel your subscription if you do not agree to the new price.
- What you get. Feedia+ provides expanded usage allowances for certain features. The specific benefits of Feedia+ are described in the App Store listing and in the Services and may change over time as the Services evolve.
8. Intellectual Property
The Services, including all software, design, branding (Feedia name, logos, wordmarks, and similar marks), text, images, and other materials we provide (excluding Your Content and third-party content), are the property of Feedia and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to download, install, and use the Feedia application on devices you own or control, solely for your personal, non-commercial use, subject to these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the Services without our prior written consent.
9. Third-Party Content and Services
The Services may display or link to content provided by other users or by third parties. We do not endorse, control, or take responsibility for third-party content, websites, or services.
The Services depend on third-party providers — including Amazon Web Services, PostHog, Sentry, OpenAI, Spoonacular, Neon, and Apple — for hosting, analytics, AI processing, payment processing, and other functions. Your use of these features is also subject to those providers' terms and privacy policies as described in our Privacy Policy.
10. Copyright Complaints (DMCA)
If you believe content on the Services infringes your copyright, please send a notice to our designated agent at support@feediaapp.com that includes:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail to permit us to locate the material (such as the URL or a description of where it appears in the Services).
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
We may terminate the accounts of users we determine are repeat infringers.
11. Termination
11.1 By you
You may stop using the Services at any time. To delete your account, go to Settings → Delete Account in the app. Account deletion follows the process described in our Privacy Policy, including a 14-day grace period during which you can restore your account.
11.2 By Feedia
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms or the rights of any third party.
- Your use of the Services exposes Feedia or others to legal liability.
- Continued provision of the Services to you is no longer commercially reasonable.
- You have engaged in fraud, abuse, or other harmful conduct.
11.3 Effect of termination
Upon termination, your right to use the Services ends. Sections of these Terms that by their nature should survive termination — including Sections 3.2, 3.5, 4, 8, 12, 13, 14, 15, 16, and 17 — will continue to apply.
12. Disclaimers
The Services are provided "as is" and "as available," without any warranty of any kind, whether express, implied, or statutory.
To the maximum extent permitted by law, Feedia disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Services will be uninterrupted, secure, error-free, free of viruses or other harmful components, or that defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any content available through the Services, including recipes, nutrition information, AI-generated output, or user-generated content.
Your use of the Services is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Feedia and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost profits, lost data, business interruption, personal injury, or property damage, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
In no event will Feedia's total aggregate liability arising out of or related to these Terms or your use of the Services exceed the greater of (a) the amount you paid Feedia in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Feedia, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services.
- Your violation of these Terms or any applicable law.
- Your violation of any third party's rights, including intellectual property or privacy rights.
- Your Content or any content you submit through the Services.
15. Modifications to the Services
We are continuously improving the Services. We may add, change, suspend, or discontinue any feature at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.
16. Dispute Resolution and Arbitration
16.1 Informal resolution first
Before filing a claim, you agree to try to resolve the dispute informally by contacting support@feediaapp.com with a written description of the claim. We will try to resolve the dispute within 60 days of receiving your notice.
16.2 Binding arbitration
If we cannot resolve the dispute informally, you and Feedia agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration will be conducted in English. The seat of arbitration will be in Travis County, Texas, unless you and Feedia agree otherwise or the arbitrator determines a different location is necessary to avoid undue burden on you. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
16.3 Class action waiver
You and Feedia agree to bring claims against each other only in our individual capacities, not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
16.4 Exceptions
The arbitration requirement does not apply to:
- Claims that may be brought in small-claims court if they qualify and remain in that court.
- Claims for injunctive or other equitable relief to stop unauthorized use of the Services or infringement of intellectual property rights.
16.5 Opt-out
You may opt out of the arbitration and class-action waiver in Section 16 by sending written notice of your decision to support@feediaapp.com within 30 days of first accepting these Terms. Your notice must include your name, your Feedia username, and a clear statement that you opt out of arbitration. Opting out will not affect any other provision of these Terms.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to Section 16, any disputes that proceed in court must be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
18. Apple-Specific Terms
Because you obtain the Feedia application through the Apple App Store, the following additional terms apply:
- These Terms are between you and Feedia only — Apple Inc. is not a party. Apple has no responsibility for the Services or their content.
- The license granted to you for the Feedia application is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- If the Services fail to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the application. Apple has no other warranty obligation regarding the application.
- Apple is not responsible for addressing any of your claims relating to the Services, including product liability claims, claims that the Services fail to conform to legal or regulatory requirements, or claims under consumer protection or similar legislation.
- If a third party claims that the Services infringe its intellectual property rights, Feedia (not Apple) is solely responsible for investigating, defending, settling, and discharging the claim.
- You represent that you are not located in a country subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide additional notice — such as an in-app message or an email to your registered address — before the changes take effect. Your continued use of the Services after a change to these Terms means you accept the updated Terms.
20. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Feedia regarding the Services and supersede any prior agreements.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
- Assignment. You may not assign these Terms or any rights under them without our prior written consent. We may assign these Terms at any time without notice.
- No agency. No agency, partnership, joint venture, or employment relationship is created by these Terms.
- Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
